While we strive to provide uninterrupted access, the provision of unlimited services is contingent upon the operational limits of our systems and the availability of resources. We reserve the right to monitor usage to ensure system stability and performance for all users.
5.3 Enforcement
We, at our sole discretion, reserve the right to limit, suspend, or terminate access to any "unlimited" service for any account that demonstrates usage that is deemed abusive, excessive, or inconsistent with typical individual usage patterns. This includes, but is not limited to: Using automated or excessive volume requests (e.g., scripting, bots). Activity that negatively impacts the performance or stability of the platform for other users. Usage that materially exceeds the average usage of other customers.We may implement resource limits (such as request throttling or daily caps) without prior notice to manage system load, particularly in instances where the usage approaches our operational resource limits.
6. Passes, Payments, and Refunds
Our pricing and payment terms are available on the Service. Payments are processed securely by Stripe. We do not store credit card details.
6.1 Passes & Cancellations
Paid passes unlock access for a period of time and provide credits that can be used to access certain features; There are no subscriptions or renewals and every pass is a one-time payment; Refunds are not issued for partial billing periods unless required by law. We only consider refunds for faulty services and when no credits have been used and no more than a day of the activation plan as passed;
7. Use of the Service
You agree not to: Use the Service for illegal or harmful purposes; Attempt to gain unauthorized access to our systems; Reverse-engineer or resell the Service; Upload or transmit malicious software or content; We may suspend or terminate access if we believe you have violated this section;
8. User Content
You retain ownership of all content you upload or create within the Service. By using the Service, you grant us a non-exclusive, worldwide license to host and process your content solely for operating and improving the Service; We may remove or restrict content that violates these Terms or applicable law;
9. Intellectual Property
All rights, title, and interest in the Service and its content (excluding user content and AI generated content) are owned by GuideMeAround. Some content is provided by open source and under free license by third parties, this content is identified in the Service. You may not copy, modify, distribute, or create derivative works without our written consent, or in the case of third party content, without the appropriate license;
10. Service Availability and Disclaimer
We strive to provide reliable access but do not guarantee uninterrupted operation. Maintenance, updates, or outages may temporarily affect access; It is not warranted that GuideMeAround will meet your requirements or that its operation will be error free; Although we strive to provide accurate information, it is not warranted that the content provided, which may include AI-generated, will be accurate, complete, or reliable. GuideMeAround is provided "as is" and is suitable only for entertainment purposes; We may modify or discontinue features without prior notice when reasonable;
11. Limitation of Liability
To the maximum extent permitted by law: The Service is provided “as is” and “as available”; We make no warranties of accuracy, reliability, or fitness for a specific purpose; Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim; We are not liable for indirect, incidental, or consequential damages;
12. Termination
You may stop using the Service at any time. We may suspend or terminate access: For violation of these Terms; At our discretion with notice if discontinuing the Service; Upon termination, your right to access ceases immediately. We may retain data for a limited time as described in our Privacy Policy;
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the European Union and Germany, without regard to conflict of law principles. Any disputes will be resolved in the competent courts of European Union and Germany;
